Release and Waiver of Liability Agreement
Event: Mama Mo's BBQ Cook-Off
RELEASE AND WAIVER OF LIABILITY
The undersigned, on behalf of themselves and all parties associated with his/her team ("Team"), hereby agrees to the following terms and conditions as a requirement for participation in the Mama Mo's BBQ Cook-Off event ("Event").
1. ASSUMPTION OF RISK
1A. ACCEPTANCE BY REGISTRATION AND PAYMENT
By submitting the Event registration (including online or paper registration) and paying the applicable registration fee, the participant/team representative acknowledges and agrees that they and their Team are automatically agreeing to, and are bound by, all terms of this Release and Waiver of Liability Agreement, including the release, waiver, and indemnification obligations in favor of Mama Mo's, American Legion, and any of the event sponsors or affiliates connected to this event.
The undersigned acknowledges that participation in the Event involves inherent risks, including but not limited to risks associated with cooking, handling of food products, use of cooking equipment, fire hazards, heat exposure, physical exertion, and interaction with other participants and attendees. The undersigned voluntarily assumes all such risks, both known and unknown.
2. RELEASE AND WAIVER
The undersigned, on behalf of all parties associated with his/her team ("Team"), hereby agrees to indemnify and hold harmless Mama Mo's, American Legion, and any of the event sponsors or affiliates connected to this event. Mama Mo's and American Legion, its officers, directors, managers, shareholders, employees, agents, landlords, lessees, sponsors, representatives, volunteers, and affiliates (hereafter the "RELEASED PARTIES") from, and against any and all liability, responsibility, damages, losses, claims, demands, actions, suits, judgments, costs and expenses (including attorneys' fees) resulting from personal injury, accident, illness, death and/or property loss caused in any manner, including theft (personal belongings and otherwise), fire and the simple, active or passive negligence of the Released Parties, by my personal participation in connection with the Team's participation in the Mama Mo's BBQ Cook-Off event.
3. EXTENSION OF WAIVER
This waiver extends to any and all claims of liability imposed by law, whether arising from the actions, omissions, or negligence of the Team, its agents, employees, or any person performing services on its behalf, or arising from any equipment, machinery, or items displayed or used by the Team at the Event.
4. EXPRESS RELEASE
Notwithstanding any legal remedies that may otherwise be available, the undersigned expressly releases and waives all claims against the Released Parties, in consideration of the mutual covenants herein and the opportunity afforded to the Team to participate in the Event.
5. RULES AND REGULATIONS
The undersigned acknowledges having read, understood, and agreed to abide by the rules and regulations of the Mama Mo's BBQ Cook-Off.
6. AUTHORITY TO BIND
The undersigned represents and warrants the authority to bind the Team to this Release and Waiver of Liability Agreement.
7. SEVERABILITY
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
8. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.
ENTRY VERIFICATION & PAYMENT
Online registration requires immediate payment via credit card. Any registration completed WITHOUT payment will be automatically deleted.
DISCLOSURE
DISCLOSURE: I understand and agree that any registration not paid in full at the time of submission will be deleted immediately and without notice.
PHOTO RELEASE
Participants grant Mama Mo's and its affiliates permission to use their likeness, voice, and images in photographs or videos taken during the Event for promotional, marketing, or social media purposes, without compensation.
